Key Agreement Summary
SwaraBharath is an AI music studio offering 10 free trial credits upon sign up, followed by prepaid Indian Rupee (INR) credit packs via UPI. All generations using paid credits include full commercial rights.
1. Eligibility & Account Creation
You must be at least 13 years of age (or the minimum legal age required in your jurisdiction) to use SwaraBharath. You agree to provide true, accurate, and current information when creating an account and to maintain the security of your password and credentials. You are responsible for all activities that occur under your account.
2. Generation Credits & Billing
- Free Trial Credits: Every newly registered user receives 10 free credits to test our Indian music synthesis engine. Free credits have no monetary cash value and cannot be redeemed or transferred.
- Paid Credit Packs: Creators may purchase additional credits in Indian Rupees (INR) through authorized payment channels including UPI (GPay, PhonePe, Paytm, BHIM, ICICI) and net banking.
- Deduction per Generation: Each 2-variation song generation typically consumes credits according to the pricing tier outlined in our Studio interface.
- Non-Refundable Digital Goods: Because AI computation and GPU resources are consumed immediately upon processing a song generation, purchased credit packs are non-refundable once audio synthesis has commenced, except in cases of proven double-billing or documented technical failure.
3. Acceptable Use Policy
You agree not to use SwaraBharath for any harmful, defamatory, or unlawful activities, including:
- Submitting lyrics or audio prompts that promote hate speech, communal disharmony, violence, or sexual harassment.
- Attempting to deepfake or deceptively clone living artists, political figures, or copyrighted vocalists without legal consent.
- Reverse engineering, scraping, or launching automated denial-of-service (DDoS) attacks against our API servers or cloud infrastructure.
- Inputting copyrighted lyrics owned by third-party music publishers without appropriate licenses.
4. Intellectual Property & Commercial Rights
Your ownership and commercial usage rights over generated tracks depend on the account tier:
- Free Plan Generations: Granted under a Creative Commons Attribution Non-Commercial license. You may share and distribute on personal social channels with attribution to SwaraBharath.
- Paid Plan Generations: You receive 100% royalty-free commercial rights. You may distribute to Spotify, Apple Music, YouTube monetized channels, television, video games, advertisements, and client film projects. See our detailed Licensing Policy for complete legal details.
5. Disclaimer of Warranties & Limitation of Liability
SwaraBharath is provided "as is" and "as available". While we strive for pristine 48kHz audio quality and 99.9% uptime, we make no guarantees that generated audio will be error-free or suited to a specific commercial requirement. In no event shall SwaraBharath Labs, Inc. be liable for any indirect, incidental, or consequential damages resulting from platform use.
6. Governing Law & Dispute Resolution
These terms shall be governed by and construed in accordance with the laws of the Republic of India. Any disputes arising under these terms shall be subject to the exclusive jurisdiction of the competent courts in Bengaluru, Karnataka, India.
